Not to make this more complicated sounding, but this is sometimes in D Dorian. Simply put, at times a G major chord is played which has a B natural. You can play a C major scale for those areas if you like or just jam away in D minor blues or pentatonic (or whatever you like really. I'm not here to tell you how to solo).
